Introduction

These Terms of Service govern your use of Uncle Rental as a client. By creating an account and using our platform, you agree to these terms.

You must read these terms together with our Privacy Policy & Disclaimer and Cancellation & Refund Policy.

Important: English version prevails in case of conflict.

1. Acceptance & Eligibility

1.1 Your Agreement

By using our platform, you:

  • Agree to all terms and conditions
  • Confirm you have read all legal documents
  • Accept our booking and refund policies

1.2 Age Requirement

You must be 21 years or older.

By creating an account, you confirm you are at least 21 years old. If we discover you are underage, your account will be terminated immediately without refund.

1.3 Policy Updates

We may update these Terms with 30 days notice via email and in-app banner.

Continued use after changes = acceptance of updated Terms.


2. Platform Description

2.1 What We Are

Uncle Rental is a marketplace platform connecting clients with independent contractor uncles for companionship services.

2.2 Our Role

We:

  • Provide the technology platform
  • Facilitate bookings between you and uncles
  • Process payments (escrow system)
  • Handle disputes
  • Offer customer support

2.3 What We Are NOT

We:

  • Do NOT provide services ourselves
  • Do NOT employ uncles
  • Do NOT supervise bookings
  • Do NOT guarantee service quality
  • Are NOT party to the service contract between you and the uncle

When you book an uncle, the service contract is between you and the uncle only.


3. Account Registration

3.1 Creating Your Account

To book services, you must:

  • Provide your real name
  • Use a valid email address
  • Create a secure password
  • Confirm you are 21+

3.2 Account Accuracy

You agree to:

  • Provide accurate and complete information
  • Update information if it changes
  • Use your real identity (no fake names)
  • Maintain only one account per person

Creating fake profiles or using false information will result in immediate account termination.

3.3 Account Security

You are responsible for:

  • Keeping your password secure
  • All activity under your account
  • Notifying us of unauthorized access

Do not share your account with others.


4. Booking Process

4.1 How to Book

  • Browse uncle profiles
  • Review information, rates, and availability
  • Message uncle (optional but recommended)
  • Create booking with date, time, and location
  • Pay via Stripe (secure payment)
  • Confirm with uncle before meeting
  • 4.2 Booking Details

    You should include:

    • Your full name and contact details
    • Specific date and time
    • Meeting location
    • Any special requests or preferences

    4.3 Payment

    Payment Breakdown
    • Uncle's rate: Amount you agree upon (HK$100–10,000/hour)
    • Platform fee: 10% added to uncle's rate
    • Total: What you pay
    Example:
    • Uncle's rate: HK$400/hour
    • Your total: HK$440 (HK$400 + 10% platform fee)
    Payment Method
    • All payments made via Stripe (secure)
    • Card details not stored with us
    • Funds held in escrow until service completion

    4.4 Funds in Escrow

    Your payment is held securely until:

  • You receive the service
  • You confirm completion
  • Payment is released to uncle
  • This protects both you and the uncle.


    5. Service Scope

    5.1 What IS Companionship

    Appropriate services include:

    • Meal companionship (dinner, coffee, lunch)
    • Event attendance (concerts, exhibitions, social events)
    • Shopping or activity partner
    • Mentoring and life advice
    • Career guidance
    • Friendly conversation and support

    5.2 What IS NOT Companionship

    Prohibited services include:

    • Sexual services or romantic relationships
    • Any illegal activities
    • Excessive physical contact beyond social norms
    • Unlicensed professional services (medical, legal, financial advice)
    • Anything violating Hong Kong law

    5.3 Meeting Location

    You must:

    • Agree on a meeting location in advance
    • Meet in public places (recommended for initial bookings)
    • Communicate clearly about expectations

    5.4 Respecting Boundaries

    Uncles are people, not services. You must:

    • Treat uncles with respect and dignity
    • Respect if they decline to do certain activities
    • Accept their decisions without pressure
    • Follow their stated boundaries

    6. Safety Guidelines

    Your safety is your responsibility. We do not supervise bookings.

    6.1 Before Your Booking

    • Inform a trusted friend or family member
    • Share the uncle's profile and meeting location
    • Use platform messaging to confirm details
    • Start with shorter bookings (1–2 hours)

    6.2 During Your Booking

    • Meet in public places
    • Stay alert and aware
    • Trust your instincts
    • End the booking if uncomfortable

    6.3 Reporting Issues

    If an uncle:

    • Behaves inappropriately or makes unwanted advances
    • Threatens or harasses you
    • Appears intoxicated or impaired
    • Attempts fraud or deception
    Report immediately:
    • End the booking and leave safely
    • Use app: Uncle Profile → Report
    • Email: safety@unclerental.com
    • Include: Booking ID, date/time, description, evidence

    7. Communication

    7.1 Platform Messaging

    • Use in-app messaging to contact uncles
    • Messages are monitored for safety (not encrypted)
    • Do not share personal contact details before booking

    7.2 Appropriate Communication

    DO:
    • Be polite and respectful
    • Communicate clearly
    • Respond promptly to messages
    DON'T:
    • Send harassing or offensive messages
    • Spam uncles with excessive messages
    • Use abusive language
    • Make threats

    Violation may result in warning, suspension, or account termination.


    8. Reviews & Ratings

    8.1 Leaving Reviews

    After each booking, you can:

    • Rate the uncle 1–5 stars
    • Write a text review
    • Share your honest experience

    8.2 Review Guidelines

    You agree to:

    • Leave honest, accurate reviews
    • Base reviews on your actual experience
    • Not post false or fraudulent reviews
    • Not exchange compensation for reviews

    Prohibited reviews include:

    • Defamatory or false statements
    • Discriminatory comments
    • Blackmail or extortion

    Violating reviews will be removed.


    9. Prohibited Conduct

    You agree NOT to:

    #### Platform Abuse

    • Create multiple accounts
    • Use automated tools or bots
    • Attempt to scrape user data
    • Interfere with platform operations

    #### Fraud

    • Use stolen payment methods
    • Dispute legitimate charges (chargeback fraud)
    • Attempt to obtain services without paying
    • Pay uncles directly to avoid platform fees

    #### Harassment

    • Harass or threaten uncles or other users
    • Discriminate based on protected characteristics
    • Stalk or dox (share personal information)

    #### Illegal Activities

    • Use platform for illegal purposes
    • Facilitate prohibited services
    • Violate Hong Kong law

    Violations result in account termination, no refund, and possible legal action.


    10. Off-Platform Payments

    Paying uncles directly outside our platform is strictly prohibited.

    10.1 Why This Rule Exists

    • Platform fees fund operations and support
    • Escrow system protects both parties
    • Direct payments bypass all protections

    10.2 What Is Prohibited

    • Cash payments during bookings
    • Bank transfers to avoid fees
    • Arranging "private bookings"
    • Paying uncles directly before/after booking

    10.3 Consequences

    • Immediate account ban (permanent)
    • No refund of any fees or payments
    • Loss of all platform protections
    • Possible legal action

    11. Account Termination

    11.1 You Can Close Your Account

    You may delete your account anytime via Settings → Delete Account.

    Effect:
    • Account deleted within 30 days
    • Cannot create new account with same email
    • Any pending bookings must be cancelled
    • Cancellation policy applies to pending bookings

    11.2 We Can Terminate Your Account

    We may suspend or terminate your account if you:

    • Violate these Terms
    • Engage in prohibited conduct
    • Pose safety risk to uncles or users
    • Abuse the refund system
    • Attempt fraud
    • Undergo legal proceedings related to platform use
    Effect:
    • Immediate loss of access
    • No refund of fees
    • Pending bookings cancelled
    • Permanent ban from platform

    12. Off-Platform Relationships

    12.1 Relationships Outside Bookings

    If you develop a friendship or relationship with an uncle outside our platform, that is entirely outside our control and responsibility.

    12.2 No Platform Protection

    For interactions outside bookings:

    • We cannot monitor or supervise
    • No dispute resolution available
    • No refund protection
    • No safety oversight

    If you want platform protections, book through our system.


    13. Intellectual Property

    13.1 Our Content

    All platform content (text, images, design, code) is owned by Uncle Rental and protected by copyright law.

    You may NOT:

    • Copy or modify platform content
    • Use our logos or branding without permission
    • Create derivative works
    • Sell or commercialize our content

    13.2 Your Content

    When you post reviews, messages, or profile information:

    • You grant us worldwide license to use your content
    • We may moderate or remove content
    • We may feature your reviews in marketing

    You retain ownership of your content.


    14. Disclaimers

    See our Privacy Policy & Disclaimer for full details. Summary:
    • Platform provided "AS IS" without warranties
    • No guarantee of uncle quality or safety
    • Verification is basic (ID only)
    • You exercise own judgment
    • We have maximum liability of HK$10,000 or 6 months of your fees
    • You assume all risks

    15. Dispute Resolution

    15.1 Issues with an Uncle

    If uncle provides poor service:

  • Try to resolve directly with uncle first
  • File dispute via app (within 48 hours of booking)
  • Provide evidence (screenshots, messages, photos)
  • Platform reviews and decides (within 5 business days)
  • Outcomes: Full refund, partial refund, or no refund Decision is final and binding.

    15.2 Issues with Platform

  • Describe issue clearly
  • We respond within 5 business days

    Jurisdiction: Hong Kong SAR Applicable Law: Hong Kong law governs these Terms Courts: Hong Kong courts have exclusive jurisdiction Language: English version prevails

    17. General Provisions

    17.1 Entire Agreement

    These Terms, our Privacy Policy & Disclaimer, and Cancellation Policy constitute the entire agreement between us.

    17.2 Severability

    If any provision is invalid, remaining provisions stay in effect.

    17.3 Amendments

    We may update these Terms with 30 days notice. Continued use = acceptance.
